NEW DELHI: In a strategic move to combat the growing issue of unsolicited commercial communications (UCC), the Telecom Regulatory Authority of India (TRAI) is mulling over the possibility of imposing limits on unlimited calling and messaging services.
In its recent consultation paper, TRAI proposed the idea of introducing differential tariffs for voice calls and SMS as a deterrent against UCC. The paper suggests implementing a differential tariff structure beyond a certain threshold for bulk messaging or calling, particularly focusing on people-to-people (P2P) communications. TRAI emphasized the necessity to reassess current regulations, with one potential approach being the imposition of higher tariffs once a specific limit for bulk communications is exceeded.
The consultation paper invites public feedback on revisiting the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR-2018). “Stakeholder opinions are sought on whether there is a need to adjust the tariff structure for P2P messages and calls per SIM on a daily basis beyond a set limit to effectively tackle the UCC menace originating from unauthorized telemarketing entities,” the paper states.

Moreover, TRAI is soliciting input on whether the current five-paisa exemption for transactional messages should be re-evaluated and aligned with the tariffs applied to other commercial messages.
The regulatory body is also exploring the potential requirement for minimum security deposits from entities registering with Access Providers to safeguard against misuse or regulatory breaches. Additionally, TRAI seeks opinions on the provisions that should be included in the Code of Practice (CoP) regarding the full or partial encashment or replenishment of security deposits in cases of regulatory violations.
The TCCCPR 2018 was initially established by TRAI to regulate commercial communications and shield consumers from UCC. This latest initiative underscores TRAI’s commitment to refining its approach to curbing the proliferation of unwanted communications and enhancing the overall regulatory framework.
